1. Acceptance of Terms
By accessing or using the services of Akshay Kotish & Co. (brand of Akshay Lakshay Kotish Private Limited, CIN: U72900HR2022PTC101170), including our website, dashboard, APIs, and professional services, you agree to be bound by these Terms of Service.
2. Services
We provide:
- ERP platform for billing, invoicing, accounting, payroll, and business management.
- Chartered accountancy and business consulting services.
- Payment processing via Razorpay integration.
- AI-powered document drafting, email composition, and ledger management.
- Template design tools for letterheads and invoices.
- API access for third-party integrations.
3. User Accounts
- Accounts are created by administrators. Users are authenticated via phone OTP or email OTP.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must not share your account or allow unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these terms.
4. Payment Terms
- All invoices are payable within the terms specified (default: 30 days).
- Late payments may attract interest at 18% per annum.
- Payments are processed securely via Razorpay. We do not store card details.
- All prices are in Indian Rupees (INR) and subject to applicable GST.
5. Intellectual Property
The platform, its design, code, templates, and branding are the intellectual property of Akshay Lakshay Kotish Private Limited. You may not copy, modify, or distribute any part of the platform without written permission.
6. Data & Privacy
Your use of our services is also governed by our Privacy Policy. By using our services, you consent to our data practices as described therein.
7. Limitation of Liability
- Our services are provided "as is" without warranties of any kind.
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability shall not exceed the fees paid by you in the preceding 12 months.
- We are not responsible for third-party service outages (Razorpay, Google, Firebase, etc.).
8. Prohibited Uses
You may not use our services to:
- Engage in fraudulent, illegal, or deceptive activities.
- Transmit malware, spam, or harmful content.
- Attempt to gain unauthorized access to our systems.
- Violate any applicable laws or regulations.
9. Termination
Either party may terminate the service relationship with 30 days written notice. Upon termination, you may request export of your data. We will retain financial records as required by law.
10. Governing Law & Jurisdiction
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Kaithal, Haryana.
